you have to have a certain amount of tread depth , depending on your state laws, after doing inspections for years my self , a mechanic can tell just by looking at them or they could use a tire depth gauge, either way you dont have to buy tires there but the inspection is a safety inspection and after getting a second opinion on your tires go buy some good new or used tires and keep yourself safe.

Most (if not all) tires made in the last 25 years have wear indicators built right into them. A simple glance can show if they need replacement or not.
Therefore, it is not a subjective guess by the inspector.

Tires have what are called tread wear indicators.
These are actually just spots molded into the tires so you can tell visually when the tires are worn beyond minimum safe levels.
They appear as breaks in the tread when worn to that point.
